Background

:

The Federal Government of Somalia (FGS) has received financing from the World Bank through the Somalia Productive, Resilient and Inclusive Growth Project (SPRING Project) and intends to apply part of the proceeds of the above project to finance the Consultancy Services for the Integrated Legal and Regulatory Harmonization Initiative for the Business Environment.

Responsibilities

The firm will be responsible for reviewing, harmonizing, and modernizing Somalia’s business-related legal and regulatory frameworks, including the Company Law, commercial registration and licensing rules, SME and Startup Legal Act, and the Information Governance Framework for SBRLS. It will conduct legal and institutional assessments, identify gaps, draft laws and regulations, lead stakeholder consultations, validate proposed reforms, and prepare final legal reform packages, implementation roadmaps, and completion reports. The firm must also ensure quality, confidentiality, inclusive engagement, and alignment with international good practice and Somalia’s institutional needs.

The firm is expected to complete the proposed assignment within 12 months.

Consultants may associate with other firms to enhance their qualifications but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected

A Consultant will be selected in accordance with the

Quality and Cost-Based Selection (QCBS)

method set out in the Procurement Regulations.

1. Core business of the firm; The firm shall have at least 10 years of experience in legal and regulatory reform, demonstrated experience in similar assignments, and capacity to deliver multidisciplinary expertise.
2. Specific experience in successfully implementing similar assignments. (The firm must have at least 10 years of experience in legal and regulatory reform, with proven experience in similar assignments. It should demonstrate strong expertise in business environment reform, legal harmonization, digital governance, stakeholder engagement, and multidisciplinary legal drafting. The firm must also have the capacity to deliver high-quality diagnostics, consultations, legal frameworks, reform packages, and reports in English and Somali. The Consultant shall provide the name and contact address of the Client (office and e-mail address and telephone number), date(s) of execution, name (s) of lead and associate firms, contract amount, and financing sources.
3. Experience of relevant services in an environment similar to that of Somalia and
4. Technical and managerial organization of the firm (provide only the structure of the organization). Do not provide CVs of key staff. Key experts will not be evaluated at the shortlisting stage.
